Terms of Service
These Terms of Service (“Terms”) govern your use of Dayvil, including the Dayvil mobile app, website, and related services. By using Dayvil, you agree to these Terms.
1. What Dayvil is
Dayvil is a visual day-tracking tool for actions, routines, reminders, metrics, time-based tracking, reports, and shared support contexts. Dayvil is designed to help you understand your day; it does not make decisions for you.
2. Health and professional-advice disclaimer
Dayvil is not a medical device and is not a substitute for medical, mental-health, legal, financial, or other professional advice. Dayvil does not diagnose, treat, cure, or prevent any disease or condition. Do not rely on Dayvil for emergencies or safety-critical reminders. Always consult a qualified professional for decisions that may affect your health, safety, legal rights, finances, or wellbeing.
3. Eligibility and accounts
You may use Dayvil only if you can legally agree to these Terms. Dayvil is not directed to children under 13. If you use Dayvil on behalf of another person, a child, a parent, or another family member, you are responsible for having the right to do so and for choosing what information is entered and shared.
Dayvil may allow anonymous use. If you continue anonymously, you are responsible for keeping access to the device and app data. Linking your account with Google or Apple can help preserve access across devices. You are responsible for keeping your account secure.
4. Your content
You keep ownership of the actions, routines, entries, notes, settings, and other content you create in Dayvil. You grant Dayvil the limited rights needed to host, sync, process, display, back up, and share that content according to your settings and these Terms.
You are responsible for the content you enter and for making sure you have the right to enter or share information about another person.
5. Sharing features
Dayvil lets you share a Dayvil with other people. If you invite someone or accept an invitation, the shared information may be visible to people with access to that shared Dayvil. Use sharing carefully, especially where information is sensitive or relates to another person.
6. Subscriptions, purchases, and ads
Dayvil may offer paid subscriptions, paid features, free features, and ad-supported features. Purchases and subscriptions are processed by Apple App Store, Google Play, and RevenueCat. Store terms, renewal rules, cancellation rules, and refund rules may apply. You can manage or cancel subscriptions through your Apple App Store or Google Play account settings.
Ads may be shown to non-subscribed users where ads are enabled. Active subscriptions may remove or reduce ads according to the plan shown in the app.
7. Acceptable use
You agree not to misuse Dayvil. For example, you must not:
- Use Dayvil for unlawful, harmful, abusive, harassing, or deceptive activity.
- Enter or share information about another person without an appropriate basis.
- Try to access another person’s account or shared Dayvil without permission.
- Interfere with, reverse engineer, overload, scrape, or disrupt Dayvil or its infrastructure.
- Use Dayvil to store or distribute malware, spam, or content that infringes someone else’s rights.
8. Third-party services
Dayvil relies on third-party services such as Google Firebase, Google Sign-In, Sign in with Apple, RevenueCat, Apple App Store, Google Play, Google AdMob, notification services, and email providers. Their terms and privacy policies may also apply to your use of those services.
9. Service changes and availability
We may update, change, suspend, or discontinue parts of Dayvil. We work to keep Dayvil available and useful, but we do not guarantee that it will always be uninterrupted, error-free, or available on every device.
10. Account deletion and termination
You may stop using Dayvil at any time. You can request account deletion by contacting Dayvil feedback. We may suspend or terminate access if we reasonably believe these Terms were violated, if required by law, or if needed to protect users, Dayvil, or our service providers.
11. Intellectual property
Dayvil, including its name, logo, design, software, and website content, is protected by intellectual-property laws. These Terms do not give you ownership of Dayvil itself. You may not copy, modify, distribute, or create derivative works from Dayvil except as allowed by law or with written permission.
12. Disclaimers and limitation of liability
Dayvil is provided “as is” and “as available”. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the maximum extent allowed by law, Dayvil will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption. Nothing in these Terms limits rights that cannot be limited under applicable consumer law.
13. Changes to these Terms
We may update these Terms as Dayvil changes. When we do, we will update the “Last updated” date above and, where appropriate, provide additional notice in the app or on the website. Continuing to use Dayvil after an update means you accept the updated Terms.
